Yes, there is currently a multi-district litigation case (MDL) pending in the United States District Court. The case, MDL No. 2885, is in the United States District Court Northern District of Florida before Judge M. Casey Rodgers.

In April 2019, the United States Judicial Panel on Multidistrict Litigation found that there are common issues of fact in cases being brought against 3M nationwide. Specifically, the court found that all pending cases involve common factual issues about whether 3M Dual-ended Combat Arms™ earplugs were defective, and, therefore, caused hearing loss or tinnitus.

The cases were centralized and transferred to the Northern District of Florida on April 3, 2019.

Since then, the court has issued various pretrial and case management orders. Pretrial conference dates have been set for 2020, and as of February 2020, the dates for bellwether trials have not yet been scheduled.

Should You Join the 3M MDL?
