No. However, you should be prepared to hear an insurance adjuster argue that your eye injury was your fault because you failed to wear goggles. The insurance adjuster may be trying to get you to accept a settlement that is lower than you deserve.

  • Iowa law does not require motorcyclists to wear goggles. Thus, you were doing nothing wrong by failing to wear them.
  • You suffered the eye injury because of the accident and not because of the lack of goggles. It was not the absence of goggles on your face that caused your eye injury. Instead, it was the negligent actions of the other driver. Don’t let the insurance adjuster confuse this point.
  • You deserve fair compensation for your eye injury, and any other injuries you suffered, if you were hurt because of another driver’s negligence.
