Our client was operating a semitruck on the interstate when he crested a hill and came upon a dump truck that was idling in his traffic lane. He tried to swerve out of the way, but did not have enough time to avoid rear-ending the dump truck. Our client’s semitruck careened into the median, caught fire and our client suffered severe burns to his leg.
The dump truck’s insurance company denied the claim because the driver said he was traveling at normal speed and was not stopped in the middle of the highway. Due to the severity of the damage of the semitruck and the age of the dump truck, no event data was recorded that would prove our client’s version of the events.
Attorney James Carlson moved forward with the case. The insurance company then only offered $255,000 to resolve the case. Attorney Carlson filed a lawsuit and the case was resolved for $570,000 at mediation.
