Our client was riding his motorcycle through an intersection in Belvidere in 2021.  The defendant ran a red light and struck our client, knocking him from his bike. 

The insurance company for the at-fault driver refused to make an offer because their insured claimed his traffic light was green.  However, eyewitness statements contradicted the defendant and he was exposed as being untruthful during his deposition (his demeanor was horrible as well).  The at-fault insurance company continued to refuse to offer their insurance policy limits of $25,000, and instead kept trying to offer the plaintiff less than the policy. 

Finally, the insurance company offered $24,000. Attorney James Theisen threatened the insurance company with a bad faith claim and insisted that his client recover the entire $25,000 policy.  The insurance company relented and offered their entire policy.  Our client accepted and the firm continued with a successful under insurance claim on the client’s behalf as well.
