One February day, our client was struck by a motorist who deviated from his lane of traffic and struck her vehicle. As a result of the impact, our client lost control of her vehicle, which left the roadway, struck a fence and rolled onto its side. She was extricated from the vehicle with serious injuries.
Our client retained our office and Attorney Evan Claditis started a lawsuit against her own insurance company through her uninsured motorist provision. During the course of the lawsuit, the insurance company offered to settle our client’s case for $40,000, which was rejected. However, after Attorney Claditis took the sworn testimony of two key witnesses, the insurance company relented and our client’s case was settled for $175,000, without the need for a trial.
