Our client was injured when another driver failed to yield the right of way and pulled out from a T-intersection stop sign right in front of her car. The insurance company denied the claim on the grounds that our client did not have her headlights on and was therefore allegedly not visible to their insured driver.
A lawsuit was filed and the case settled FOR $26,600 after Attorney Timothy Schelwat proved the Wisconsin statutes did not require headlights to be illuminated at the time of day the collision occurred.
