On a February evening a Boone County, Illinois, resident and member of the armed forces stopped to render aid at an accident scene. As he was crossing the street, he was struck by another motorist who was gawking at the scene.

The insurance company said he was primarily at fault for the accident, because he was not crossing at a cross walk and was wearing dark clothing. After another lawyer declined to represent him due to these liability issues, Hupy and Abraham took the case.

The insurance company made a minimal offer to our firm, again stating that they believed our client was the majority at fault. After Attorney Vito J. Manicioto declined to entertain a minimal offer and threatened suit, the insurance company agreed to settle. The insurance company paid our client $85,000, fairly compensating him for his injuries.
