On September 30, 2005 in Janesville, Wisconsin, Angel LeDesma was traveling north on Milton Avenue with the intent of turning on Humes Road. Just as she began to turn, two vehicles traveling south on Milton ran a red light while racing each other. One of the vehicles smashed into Ms. LeDesma's vehicle and caused significant damage to both vehicles.
Shortly after the accident, Ms. LeDesma began to feel persistent pain in her lower back and right leg. She treated with a physician and chiropractor and, though it improved, her pain unfortunately never went away.
The insurance company for the at-fault driver, American Family Insurance, argued that the pain Ms. Ledesma was experiencing did not result from her accident but rather that it was merely a continuation of discomfort she had during earlier pregnancies. They offered Ms. LeDesma only $1,000.
Attorney Brandon Derry of Hupy and Abraham in Madison filed a lawsuit on Ms. LeDesma's behalf and proceeded to trial.
At trial, Attorney Derry overwhelmingly convinced a Rock County Jury that American Family Insurance was wrong and, as a result, the jury awarded Ms. LeDesma more than $50,000—more than fifty times the settlement offer from the insurance company..
