On a dry winter day in December 2012, Hupy and Abraham's client was stopped at a stop sign on the cross street of Mequon Road and Cedarburg Road in Mequon, Wisconsin. Before our client could turn right, a negligent driver rear-ended his vehicle.

Our client had a previous spinal surgery in which he received a hardware placement. Doctors were initially concerned that the hardware may have been damaged in the accident. To find out, the doctors ran tests which fortunately came back negative.

The insurance company refused to cover the cost of these tests, arguing that they were expensive and unnecessary. They contended that, due to the nature of the accident, hardware damage couldn't possibly have occurred. Attorney Thomas Perlberg filed suit and the insurance company shifted it's stance. The case was ultimately settled for $25,000 without a trial.
