Our client was driving his vehicle east on Interstate 94 in Waukesha County during November 2020. Suddenly and without warning, a reckless driver, also traveling east on I-94, lost control of his vehicle and collided with our client. As a result of the collision our client was injured.
Following negotiations, the insurance company for the responsible driver offered policy limits in the amount of $50,000 to settle the liability claim. Once those policy limits were accepted, it was time to pursue additional compensation through our own client’s underinsured motorist coverage. This coverage is utilized when the at-fault driver has insurance, but not enough insurance to cover the reasonable value of the claim. Unfortunately, our client’s insurance company did not believe his case was worth more than $50,000, but offered $2,000 to avoid a lawsuit.
This offer was immediately rejected and a lawsuit commenced. Without the need for trial, Attorney Evan Claditis was able to settle our client’s underinsured motorist claim for an additional $250,000.
