Client Breaks Wrist at DMV, Receives $45,000 Settlement

Our client was elderly and went to the DMV to renew her driver’s license. She walked with a cane. The DMV attendant saw her walking and asked her to walk for her. The client tried walking without her cane and immediately fell and broke her left wrist.   

Attorney Todd Korb claimed there was a violation of Wisconsin law and the ADA as there was a regulation saying the DMV can ask for a doctor to fill out a form authorizing driving and issue a temporary license but can’t require physical tests be performed by the applicant. After extensive litigation, including discovery and motions, Attorney Korb recovered a settlement of $45,000 from the State of Wisconsin.
