
Our client was a passenger in a UTV. The driver was intoxicated and went off the roadway and hit a tree. The driver said there was a deer in the roadway and he had to swerve to avoid it. Our client denied a deer was involved.
The insurance company argued our client was negligent for not wearing a seat belt and getting in a vehicle with someone he knew was intoxicated.
After being thrown from the vehicle, our client suffered an injury to his eye. The initial offer was $150,000. Attorney Todd Korb was able to get the case settled for $450,000.
