Our client was riding in the back of a motorcycle group when a cyclist ahead of him missed a curve, causing him to drive through an oncoming lane of traffic and off the road. In the other lane, a truck swerved to avoid the cyclist and into our client’s lane, causing him to swerve into the oncoming lane to avoid the truck. He lost control of his motorcycle in the gravel on the side of the road and had to dump his bike, causing injuries to his head, chest, and right knee.

The claim was denied by both the cyclist’s and truck driver’s insurance companies, taking the position that the accident was our client's fault for either traveling too fast or failing to maintain proper management or control over his motorcycle.

After litigation, the case was settled at mediation with both insurance companies paying a total of $63,300.
