Attorney Shawn Brock secured a total recovery of $100,000 for a client who was injured as a passenger in a vehicle that was rear-ended while slowing for traffic ahead making a left-hand turn. The at-fault driver carried only the state minimum liability limits of $25,000, which were offered due to the client’s back and hip injuries. However, the vehicle in which our client was riding had an additional $75,000 in Underinsured Motorist (UIM) coverage. The UIM carrier initially refused to pay, arguing that the client’s injuries were not caused by the rear-end collision. After a lawsuit was filed and discovery was conducted, the UIM carrier ultimately tendered its full $75,000 policy limits, resulting in a $100,000 total recovery for our client.
