Pedestrian Struck While Crossing Street Receives $100,000 Policy Limit

On the night of December 16, 2013, Hupy and Abraham's client was struck by a car while crossing the street.  The insurance company argued the client was responsible because he negligently crossed the street into the path of their driver. They refused to pay the policy limits and requested a set-off based on the client’s contributory negligence.

Attorney James Theisen rejected the insurance company’s argument and demanded the $100,000 policy limits. The insurance company complied and our client received $100,000.
