What can you do when your night on the town turns into a nightmare?

Suppose you are celebrating New Year’s Eve in one of Milwaukee’s many bars, lounges, or nightclubs. You and your friends are enjoying a drink and listening to music while you wait for the midnight countdown. You are on your way to get another drink when you step in a spilled beer and fall. Your ankle is broken. Instead of celebrating with friends, you’ll be ringing in the New Year from the emergency room.

You didn’t see the spilled drink. You weren’t really looking, but the lighting was low, so you may not have seen it anyway.

Low lights create atmosphere. A date isn’t quite as romantic in the glare of fluorescent lights. Mood lighting means people are more likely to hang out and linger. In fact, bar owners know that low lighting increases profits. But it also increases the risk of injury to patrons.

Nightclubs, like any other business, have two duties to their patrons:

  • They must provide a safe environment
  • They must warn of any hazards

This means that the nightclub owner must consider any likely hazards and do his best to prevent these hazards from causing injury. This doesn’t mean the bar must resort to fluorescent lights; many night clubs use floor level lighting and light-up decorations to improve visibility while maintaining a cozy atmosphere.

Causes of bar, pub, and nightclub slip and falls

  • Poor lighting
  • Spilled drinks
  • Broken glass
  • Uneven flooring or loose carpeting
  • Ice, snow, or water near doorways
  • Obstacles such as wires and cables
  • Other patrons who have had too much to drink

If you are injured because of a slip and fall in a pub, bar, or nightclub, the bar owner may be financially responsible for your injuries. If this is the case, the bar’s insurance company must compensate you for your medical bills, lost wages, and other damages. However, determining liability and obtaining compensation isn’t always easy. You have to show that the nightclub either failed to meet health and safety standards, or failed to meet their duty to provide a safe environment for customers.

The Milwaukee slip and fall lawyers at Hupy and Abraham can determine if the bar, tavern, or nightclub is responsible for your injury. If you have a case, we can determine which insurance company is responsible for your damages and file a claim on your behalf.
