On August 9, 2012, Hupy and Abraham's client was a passenger in a car heading southbound on Gammon Road in Madison, Wisconsin. The vehicle was rear-ended and the client sustained soft tissue injuries to his neck and back, aggravating pre-existing health conditions.
The claim stalled in negotiations and the insurance company failed to make an offer. In fact, the insurance adjuster said he couldn't even authorize an offer. Hupy and Abraham threatened to file a lawsuit and all involved parties then agreed to participate in a pre-suit mediation. The case settled for $75,000.
