I am consistently asked how ‘fault’ is calculated in an accident case.  Generally, there’s going to be some fault attributed to both of the drivers.

For example, if you are suddenly confronted with a vehicle turning left in front of you, and have an accident, the person who made the left-hand turn is 85 percent at fault for the accident, and the you are 15 percent at fault for the accident. Even if you were going the speed limit, and there was nothing you could do, juries generally find fault on both of the drivers in this type of scenario. 

The only time that we consistently see no fault with our clients is when they are rear-ended.
