When She Was Hit, The Insurance Company Claimed She Stopped “Too Quickly”

During a blizzard, our client was northbound on U.S. 41/45. Traffic was backed up due to other weather-related crashes. Our client was able to safely stop, but a defendant driving too fast for the conditions rear-ended our client.

The insurance company claimed our client stopped too quickly causing the defendant to rear-end our client. The insurance company only offered $8,500 and argued our client’s quick stop make her equally responsible for the accident.

Attorney Shawn Brock filed a lawsuit and depositions were taken. The depositions showed our client was able to stop in time for the backed-up traffic and that the defendant was driving too fast for conditions and rear-ended our client. The insurance company conceded liability, and the case was settled at mediation for $26,841.65.
