In May 2012, Hupy and Abraham's client was a rear seat passenger in a vehicle that was rear-ended at a stoplight in Milwaukee, Wisconsin. The impact thrusted him forward and he struck the seat in front of him.

Initially, the client had no pain or head symptoms. Weeks went by without any issues until one day he noticed a change in his vision. After extensive testing, his doctors determined that the accident damaged a medical implant and a revision surgery was performed.

The insurance company argued the impact was not significant enough to cause this issue. Attorney Thomas Perlberg filed suit and obtained $120,000 without going to trial.
