Motorcyclist Turns Down $100,000 Offer and Receives Over $1 Million

On July 10, 2004, Ronald Sobiesczyk was operating his 2004 Harley Davidson soft tail motorcycle in Shorewood, WI. As he was traveling Southbound on Oakland Avenue, a driver suddenly pulled out and started to make a left hand turn in front of his motorcycle. Although Mr. Sobiesczyk attempted to veer right to avoid this vehicle, he was unable to do so, and his left leg smashed into the driver side front bumper of the vehicle. It was obvious at the scene of the accident that he had suffered a very serious leg injury as a result of this impact. Mr. Sobiesczyk was transported from the scene of the accident to Froedtert Memorial Lutheran Hospital. The doctors at Froedtert did everything in their power to attempt to save Mr. Sobiesczyk’s leg. Unfortunately, after numerous surgeries, the doctors were unable to do so, and were forced to amputate his leg above the knee.

The insurance company from the outset indicated that Mr. Sobiesczyk caused the accident by inexplicably driving right into the defendant’s stopped car. The insurance company made an offer before a lawsuit was started in the amount of $100,000 and indicated that if the offer was not accepted it would be withdrawn and no other offers would be made. Attorney Jason F. Abraham immediately started a lawsuit against the other driver and her insurance company. Through hard work and aggressive litigation techniques Attorney Abraham was able to convince the insurance company that their driver was the majority at fault. As a result, the insurance company made numerous offers, which were rejected and ultimately settled the case for $1,050,000.00 two days before the start of the trial.

Although Mr. Sobiesczyk’s life will forever be altered as a result of this accident, he is now able to go back to work with the use of a prosthetic leg. Mr. Sobiesczyk indicated that he was very thankful for the hard work that Attorney Abraham did in resolving the case for $950,000.00 more than the insurance company originally offered.
